Congressmen Ritchie Torres and Dan Goldman handed Santos a copy of the complaint Tuesday on Capitol Hill.
This marks Hochul's first State of the State address since becoming the first woman elected governor in New York.
Gov. Hochul will go first at 1 p.m., followed by Murphy at 2 p.m.
His attorneys identified the material when cleaning out office space at the center and immediately notified the White House counsel.
The visit is his first to the U.S.-Mexico border as president.
The complaint was filed by the Campaign Legal Center and accuses Santos of illegally using campaign funds for personal expenses.
