On Monday, a jury cleared 34-year-old Naeem Davis of charges in the 2012 confrontation after his attorney said he acted in self defense.
Naeem Davis was arrested in December after police said he pushed Ki-Suck Han, 58, to his death in front of the train at the 49th Street subway station.
The lawsuit filed Friday by the family of Ki-Suck Han seeks unspecified damages stemming from his December 3 death.
A man accused of pushing another to his death from a Midtown subway platform will have to stay behind bars after a judge Friday denied him bail.
Defense attorney Stephen Pokart hinted to the judge that the push was somehow justified, that the victim was the aggressor pursuing the defendant along the subway platform, refusing to leave him alone.
