Man Who Jumped Turnstile While Carrying Illegal Gun Sentenced To 7 Years

NEW YORK (CBSNewYork) -- A man who hopped a turnstile at a Manhattan PATH station last year got a little more than he bargained for after officers stopped him and found a loaded illegal gun.

Ruben Sanabria, 37, was sentenced to seven years in prison after pleading guilty in December to possessing the illegal gun, Manhattan District Attorney Cyrus Vance announced Tuesday.

Officers found the loaded gun and extra bullets shortly after stopping Sanabria for evading the $2.25 fare.

"This defendant illegally carried a loaded semi-automatic firearm into a public transportation system used by thousands of people every day," said Vance. "The officers who apprehended him did so at great personal risk. Preventing gun violence is one of my top priorities as District Attorney, and I will make sure that this Office continues to seek strong sentences for crimes involving firearms."

Sanabria was approached by officers around 4:30 a.m. on March 30, 2012, after he jumped the turnstile at the 14th Street PATH station. Officers noticed Sanabria reach for his waistband and ordered him to put his hands against the wall.

Instead, Sanabria tried to run off and threw the loaded .40-caliber Smith & Wesson and eight cartridges on the ground, according to the DA's office.

In addition to seven years in state prison, Sanabria will also face three and a half years of post-release supervision, according to the DA's office.
