Jury Resumes Deliberations In AC Vote Fraud Case

MAYS LANDING, N.J. (CBSNewYork/AP) -- Jurors in an Atlantic City vote fraud trial have returned Wednesday for a second day of deliberations.

The jury will decide whether Councilman Marty Small and five co-defendants tried to steal the 2009 Democratic mayoral primary election by tampering with or mishandling messenger absentee ballots designed for those too sick or confined to make it to the polls on Election Day.

Tuesday afternoon, they asked a number of questions regarding electoral law, but grew tired waiting for answers after nearly two hours of debate between the state attorney general's office and defense lawyers. They asked the judge if they could go home for the night, and were granted permission.

Small was acquitted of similar charges in 2006 involving a mayoral election in which he was not a candidate.
