DALLAS (CBSDFW.COM) - Glitches, scoring errors and now the STAAR exam is the center of a lawsuit.
A Texas lawyer filed a lawsuit on behalf of four parents, claiming testing broke the law. They want the scores from2016 to be thrown out. Petitioners of the lawsuit believe the tests are too long. A 2015 law requires the 85 percent of elementary students to finish the text within two hours and 85% of middle schoolers to finish by the three-hour mark.
"They have to follow the law, we have to follow the law. If I have to, they have to. They're not above it," said Jennifer Taylor.
Taylor's 14-year-old son Caleb has never passed the STAAR exam. "It breaks my heart because I see the light go out in his eyes," said Jennifer Taylor.
She said he is dyslexic and tests can be a challenge especially when they are hours long. "I guess that I don't have any hope. I just feel sad just knowing that I'm not going to pass it," said Caleb Taylor, who attends Lake Dallas Middle School.
Jennifer Taylor and three other moms feel the scores are invalid this year because the testing did not follow the law. "It's not extreme, I'm being a parent," said Jennifer Taylor.
A spokesperson for the TEA said they have not been officially served the lawsuit and would not provide a comment.
