Topless Empire State Building Photo Shoot Could Cost Photographer Big Bucks

NEW YORK(CBSNewYork) -- One photographer's idea of art could cost him more than $1,000,000.

Allen Henson is being sued by the owners of the Empire State Building over topless pictures of a woman that he took at the city landmark.

Tourists flock to the Empire State Building for its fame and the view, CBS 2's Hazel Sanchez reported.

"Empire State Building is really famous so I wanted to see the whole thing! Like the entire city of New York!" Ariene Agnol said.

In August, a topless attraction on the observation deck left spectators stunned.

"There's families up there. There's kids up there. That's not appropriate for a public venue," one tourist said.

Building management agreed and has decided to sue Henson for $1.1 million.

In the suit building representatives claim that Henson did not apply for the required permission to conduct a nude photo shoot on the observation deck. They called the shoot an objectionable and inappropriate activity that never would have been allowed.

Building management has also sought to permanently ban Henson from entering the building. CBS 2 reached out to building management but they did not respond to a request for comment.
