WYNDMOOR, Pa. (CBS) -- The Montgomery County district attorney's office says it will not seek the death penalty for a man accused of killing the woman he was living with earlier this year in Springfield Township.

Prosecutor Tonya Lupinacci says the district attorney didn't believe there were enough aggravating circumstances to warrant a death sentence for Johnny Fossett.

The 39-year-old man is facing first, second, and third-degree murder charges in connection with the death of 40-year-old Lori Jefferson, who was found dead last January inside the home they shared on East Mermaid Lane in Wyndmoor (see related story).

Court records say that Fossett strangled the woman, then called 911 in Philadelphia in an effort to turn himself in.

According to court records, he said their argument turned into a physical altercation.

Fossett is pleading not guilty.

The couple apparently had a turbulent history.  Fossett was arrested last November for breaking into the home, but those charges were dropped at Jefferson's request.
