Suit Claims Former Teacher Fondled Student

CORAL SPRINGS (CBS4) - A lawsuit has been filed against St, Andrew' Catholic School in Coral Springs claiming the school's former art and music teacher molested one of his students during music lessons in the boy's home from 2009 to August, 2010.

Miguel Cala, 37, worked at the school, located at 9950 NW 29th Terrace, for more than a decade. The lawsuit claims Cala first met the boy when he was his preschool teacher. At the time Cala, as the school's music minister, frequently directed his students which provided music for church services.

The suit claims Cala used his position at the parish and the school to single out potential victims and gain the trust of them and their families.

"The way it came to light was that Cala didn't show up to give a music lesson at the family home. After not showing up twice the mother actually became concerned about Cala and so she contacted the police," said attorney Jeffrey Herman who filed the suit. "When she contacted the police they told her they were looking for Cala themselves for allegations of sexual abuse. They asked her if she had boys or girls and when she told them boys, they said 'You need to talk to your boys'."

And that is when the boy told his mother that Cala had fondled him.

The boy's mother, who did not wish to be identified in this story, said she hopes this suit will hold those responsible accountable.

"This violation of our trust has changed my life and the entire life of my family forever. Mr. Cala may be in jail awaiting criminal prosecution but those who allowed him to abuse the children of our church community in such a horrific manner need to be held accountable as well. I can only hope my son will heal from what has happened to him and that no other children will be hurt by the decision of the church leaders who put our kids in harms way."

Archdiocese of Miami spokeswoman Mary Ross Agosta said their schools try to provide a safe environment for their students.

"There are background checks, the training of "Touching Safety" for our children and also the Virtus training our parents receive," said Ross Agosta. "We feel it's a complete package to keep our children safe."

Ross Agosta said during the ten years Cala was at Saint Andrew a red flag was never raised.

"During that period of time he had two background checks which were absolutely clear. He had gone through the Virtus training. Now because he was the music teacher at the school obviously there are some students and some parents that will want to have that music lesson continued. And so that is what we are assuming has occurred. That the parents of the child contracted him as private instructor."

Last September Cala was arrested in Virginia on charges that he abused another Florida boy during a private music tutoring lesson.
