Man's Conviction In Wife's Disappearance Vacated
DENTON (AP) — A state appeals court has overturned a North Texas man's 2011 murder conviction in the disappearance and presumed death of his wife and ordered him acquitted.
The Denton Record-Chronicle reports the 2nd Texas Court of Appeals cited a lack of sufficient evidence to support the conviction of Charles Stobaugh, for which he was sentenced to 25 years in prison.
He was convicted of killing his 43-year-old wife Kathy Stobaugh, who disappeared in 2004. In a 176-page opinion, a three-judge panel of the Fort Worth-based court noted no body or other evidence has been found to implicate Charles Stobaugh, who's now 58.
The Denton County District Attorney's Office has 30 days to appeal.
Kathy Stobaugh disappeared after going to her estranged husband's Denton County farm in late 2004.
