Trial Begins For 2nd Garland Murder Suspect

DALLAS (CBSDFW.COM) - The family of 26-year-old Stephen Swan was in court today for the murder trial for one of two men accused of their son's murder.

In opening statements the prosecutor told jurors that Demarius Cummings and James Broadnax shot Swan and his friend, Matthew Butler, multiple times in front of the Zion Gate Recording Studio in Garland in 2008.

"He was a brilliant young man" says Jean Swan about her son.  "He was an engineer and he was a musician" she says.  "It's hard to say how good he was."

Cummings stared at graphic pictures of the victims after they were shot.  At times Cummings appeared to be falling asleep during the trial today.

Jean and Craig Swan say they are disappointed the Dallas County District Attorneys office is not seeking the death penalty for Cummings.

Broadnax was convicted of Capital Murder and he has been sentenced to die for the murders.
