DA Declines Felony Charges Against Cowboys RB Joseph Randle

SEDGWICK CO. (CBSDFW.COM) -- The Sedgwick County District Attorney's office has declined to file felony charges against Dallas Cowboys running back Joseph Randle in a reported domestic dispute, citing a lack of evidence.

Dalia Jacobs, the mother of Randle's son, told investigators that Randle brandished a gun and broke a car window while they argued Feb. 3 at a Wichita hotel.

A statement from the District Attorney's office says the evidence was not sufficient to move forward with felony charges, though misdemeanor charges are still possible.

The three-month investigation conducted by the Wichita Police Department included witness interviews and the analyzing of all available evidence.

"The sufficiency of proof required in a criminal case is proof beyond a reasonable doubt. We find the nature of the available evidence in this instance is insufficient to meet that burden as to felony charges."

Jacobs called police around 3 a.m. at the scene and described the events as they unfolded.

"Joseph Randle just broke a window. He pointed a gun in front of somebody's car, and then he busted her window open… We need someone down as soon as possible… He plays for the Cowboys… Can you please not say who's calling? I feel really threatened."

After hanging up, Jacobs called police again and told dispatch that she and Randle had worked things out.

"Everything's fine now. You don't have to worry about it though. Please don't come. Everything is fine now."

Police arrived at the Wichita hotel and arrested Randle after a small amount of marijuana was found in his room. Those charges were later dropped.

Randle's attorney, Gary Ayers, denies that Randle ever brandished a gun.
