Race Case Settled With Uptown Dallas Bar

DALLAS (CBSDFW.COM) -After months of investigating, the U.S. Justice Department has found a popular Dallas restaurant-bar discriminated against African-American and Asian-American patrons.

In a settlement announced Tuesday, the Justice Department says in dozens of instances, the Kung Fu Saloon wouldn't allow African-American and Asian-American patrons because of their race or national origin.

The government says the establishment claimed the patrons weren't following the dress code, even though white patrons dressed nearly the same, were allowed inside.

The Justice Department says Kung Fu Saloon initiated other practices to limit African-Americans and Asian-Americans.

The man who first brought the allegations to light and filed complaints, DeAndre Upshaw, says he's very excited about the settlement agreement, and that he considers this a victory.

After receiving complaints last year, the city of Dallas also took action against Kung Fu Saloon, which paid a fine.

Dallas city councilman Philip Kingston says he's pleased the case is now settled. "We took it very seriously,

Uptown doesn't have that reputation, at least as far as my conception. I certainly don't want it to get that reputation."

Among the steps Kung Fu Saloon must take: It must post signs at the restaurant that all customers are welcome everyone no matter their background.

The restaurant must also mention that on its website, on Facebook, and in any television or newspaper advertising. They must also place their dress code in writing, and a supervisor must be available at the restaurant to explain why someone is denied entry.

All employees must receive civil rights training and a copy of the agreement with the Justice Department.

The settlement not only applies to the Dallas restaurant, but their Austin and Houston locations as well.

A restaurant manager in Dallas reached by phone declined comment.
