DENTON (CBSDFW.COM) - Ryan McMillan, the University of North Texas student who was shot and killed by a campus police officer after he was seen on video swinging an axe and bashing car windows, was drunk and possibly high according to the Tarrant County Medical Examiner's Office.

The Tarrant County District Attorney's Office released the autopsy report on Monday afternoon, more than five months after the incident occurred.

A Denton County grand jury decided last month not to charge police Corporal Stephen Bean in the shooting death of 21-year old McMillan, saying it was justified.

The McMillan family had been critical of the way the shooting happened saying they didn't believe lethal force was necessary.
