PHILADELPHIA (CBS) -- Pennsylvania Supreme Court justice Seamus McCaffery is accusing the court's chief justice, Ron Castille, of trying to take him down using a government porn e-mail scandal.

In a statement released today, McCaffery accuses Castille of engineering a "cooked-up controversy" and being fixated on taking down a fellow justice with "misleading statements and incredible hyopocrisy."

McCaffery's statement comes in response to Castille's release yesterday of an analysis showing McCaffery sent or received more than 200 e-mails to state employees from late 2008 to mid 2012 that contained sexual content.

Castille received the data from Pennsylvania attorney general Kathleen Kane, who found them as part of a review of the Jerry Sandusky investigation.

Castille is seeking action from fellow justices against McCaffery, to, in Castille's words, protect the high court's "moral authority."

Among the possibile actions the justices could take: suspend McCaffery, or file a complaint with the state's Judicial Conduct Board.

McCaffery, a former Philadelphia police officer and US Marine, apologized for the private e-mails he said were intended for friends and not for public view.

McCaffery called the e-maiils a lapse in judgment and said he is truly sorry if he offended anyone.
