Montco Man Sentenced for Dumping Murder Victim's Body

A 21-year-old Jenkintown, Pa. man will spend at least two months behind bars for helping his friends get rid of a murder victim's body in late 2008.


KYW's Brad Segall reports that Daniel Dougherty has pleaded guilty to tampering with evidence and abuse of a corpse and was sentenced to 2-23 months in the county prison followed by five years' probation.

Prosecutors say Dougherty rolled up Marc Rubin's body in some carpeting, carried it down several flights of steps at a Jenkintown apartment, and then dumped the body in the South Jersey Pine Barrens.

Defense attorney Emmett Madden says his client was high on crack cocaine at the time:

"I think the judge gave a fair sentence.  My client agrees, and he just wants to continue to work and continue to stay clean and continue to try and be a good member of the community."

Dougherty testified against his co-defendants -- Rubin's daughter Christina and her former boyfriend Jeffrey Leinheiser, who shot Rubin while he slept (see related story).

Prosecutor Kevin Steele says he clearly should have called police when he first saw the body.
