Charges Dropped Against Man Pulled Off Bus And Tased In Montco

NORRISTOWN, Pa. (CBS) --- Charges against a Philadelphia man, who was pulled off a bus and tased by Upper Moreland police, were dropped in Montgomery County Court, after a cell phone video from inside the bus surfaced.

Jeremiah Kendrick was on his way to work in October, 2013, when a Septa bus driver told him to turn his music down. Kendrick told the driver it wasn't his music, the driver called police.

Kendrick protested, saying he was only trying to get to work, that's when Kendrick's attorney Thomas Malone says the then-21-year-old was dragged off the bus.

"Dry-stunned one time inside the bus, he was tased twice outside the bus while he was face down trying to cover his head and face from being assaulted," Malone said.

The prosecution decided to not to pursue the case after they were made aware of a video taken inside the bus that the defense contends contradicted police testimony of the interaction with Kendrick.

Kendrick: "Tell me how you gonna get me to work on time."

Police: "I don't have to tell you ----, get off the bus."

The DA's office wouldn't get into specifics on why they dropped charges but they say it didn't have anything to do with possible excessive force.
