Eve Carson Update: Laurence Lovette Jr., N.C. man convicted in UNC student's 2008 death, to be re-sentenced
(CBS/AP) HILLSBOROUGH, N.C. - One of two men convicted in the 2008 death of Eve Carson, the student body president at the University of North Carolina at Chapel Hill, is scheduled to be re-sentenced Monday, CBS affiliate WRAL reports.

Laurence Lovette Jr., 22, was initially sentenced Dec. 20, 2011, to life in prison without the possibility of parole after being convicted of first-degree murder, first-degree kidnapping and first-degree armed robbery in Carson's shooting death.
Lovette was 17 at the time of the crime.
According to WRAL, the North Carolina Court of Appeals ruled in February that Lovette must be re-sentenced because of a U.S. Supreme Court ruling that requires judges to consider mitigating circumstances before sentencing someone under the age of 18 to life without the possibility of parole.
The re-sentencing hearing was originally scheduled for April 26 in Hillsborough, but was reportedly delayed due to a scheduling conflict.
Lovette's attorney, Karen Bethea-Shields, said Durham psychologist James Hilkey will present evidence during the re-sentencing hearing to try to persuade Superior Court Judge Allen Baddour to hand down a lighter sentence.
Bethea-Shields says the judge needs to consider Lovette's youth at the time of the crime and all of the things that go along with being a teenager, such as impulsive and reckless behavior, according to the station.
Demario Atwater, 25, was also convicted in Carson's death. He is serving two life terms in prison after pleading guilty to state and federal charges.
