Legislature Has Authority To Set Tuition Rates
TALLAHASSEE, Fla. (CBSMiami.com) – College students hoping to keep the state legislature from setting tuition rates were dealt a setback Wednesday.
A unanimous opinion from the 1st District Court of Appeals issued Wednesday said that the state legislature and not the Board of Governors have the ultimate authority to set tuition rates at state schools.
Former Governor and Senator Bob Graham was part of the suit that argued legislators shouldn't be the final authority on state tuition hikes.
Graham has a history with the case because one of his initiatives created the Board of Governors through an amendment to the Florida Constitution.
The appeals panel ruled that amendment did not shift the legislature's authority over tuition rates.
