Dade Man Wrongfully Released From Jail Captured

MIAMI (CBS4) - An Opa-Locka man accidentally released by the Miami- Dade County Jail after being convicted of stabbing his ex-girlfriend has been captured.

Miami Police spokesperson Willie Moreno confirmed to CBS4 that Dexter Davis, 36, was arrested after visiting an area hospital for treatment for an unknown ailment. Moreno says someone in the hospital recognized him and called police.

Police spent all day Tuesday searching for Davis after he was mistakenly released from Miami-Dade County Jail just after 9:30 a.m., according to CBS4 News partner The Miami Herald.

His release could have easily gone unnoticed had the detective who worked on the case not been driving by the jail at that very moment, reports the paper.

Puzzled, Det. Henry Payoute reportedly called the Miami-Dade State Attorney Office and discovered the error.

Daviswas arrested in June 2009 after he stabbed his ex-girlfriend numerous times in their Opa-Locka apartment. According to an arrest report,Davisleft a "12-to-14-inch butcher knife stuck in her left arm."

Davis was convicted by jury on Monday of attempted murder and armed burglary. He was scheduled for sentencing this December by Miami-Dade Circuit Judge Daryl Trawick.

Miami-Dade Corrections has launched an investigation into how it happened. The mistake may lie with Davis' jail card, a record kept for each inmate.

According to the Herald, the card states that Davis was convicted of burglary with assault and attempted murder and his sentencing court date due is in December.

However, a separate notation states that he pleaded guilty to a misdemeanor charge of violating an original "stay-away" order issued by the judge. For that, Judge Trawick sentenced him to 364 days but with credit for all time served. He had been in jail for more than one year.

Janelle Hall, a spokeswoman for the department, issued the following statement Tuesday: "Miami-Dade Corrections has initiated an internal investigation as to how Dexter Davis was released. Comments will not be made until after the investigation is complete."
