2 arrested in Rt. 9 fatality

Two men have been arraigned on charges connected to the death of a man working  at a construction site in Framingham Tuesday night.

Gregory Vilidnitsky was killed while working on a repaving project on Route 9.

Jeremy Gardner of Bridgton, Maine, was charged with vehicular homicide, drunken driving and related offenses.  He was ordered held on $100-thousand dollars cash bail.

His passenger, Walter Smith of Barre, Vermont was ordered held on $50-thousand dollars cash bail.

Deputy Police Chief Craig Davis tells WBZ NewsRadio that the 29-year-old Gardner tried to walk away but was stopped by construction workers and a Middlesex sheriff's deputy working a detail.

The 49-year-old Smith is facing charges for allegedly trying to drive, and then walk away. Police say the men were staying in a nearby motel.

They were in Massachusetts working construction in Wayland.
