Whole Foods Counter Sues Pastor Over Cake Slur Accusation

AUSTIN (CBSDFW.COM) - Austin-based Whole Foods is suing a pastor who first filed suit against the upscale grocery store chain.

Jordan Brown ordered a cake for a friend that said, "Love Wins" in reference to the legalization of gay marriage.

But when he picked it up, he says the phrase on the cake included a gay slur, so he sued.

Whole Foods says Brown is lying.

Tuesday the company released video of Brown buying that cake.

Company officials say the Whole Foods video shows the UPC sticker on top of the box, not on the bottom, like the one shown in Brown's video.

Brown is sticking to his story. "It's more than just a cake," says Brown.  "As a 30-year-old openly gay pastor, I have had to face years of discrimination and judgment for something that I had no control over."

Whole Food says the bakery worker now accused of writing the slur is part of the LGBT community.

The company is suing for defamation and seeking $100,000 in damages.
