MCKINNEY (CBSDFW.COM) - The Color Fun Fest 5k scheduled for October 24, 2015 in McKinney looked nothing like your average race.

Jonathan Ray and his wife Kelsey excitedly signed up for the nighttime neon-themed event at Myers Park.

"Color involved, we can do it together, at night. We thought it would be kind of cool," said Ray.

According to the Color Fun Fest 5k Facebook page, 1700 people planned on attending the race.

"They called it off because it rained all weekend," said Ray.

The race was first scheduled for April 2015, then October 10 and then October 24, 2015 making it the third time the race was cancelled.

Organizers promised in October they would reschedule again but haven't posted anything about a new race date.

"Are you guys just going to take our money and run," questioned Ray to CBS 11 Consumer Justice reporter Cristin Severance.

The Richardson-based company, Color Fun Fest LLC, has an F rating with the BBB and 45 complaints during the last year.

They've also been at the center of complaints in the past for cancelling or rescheduling races all over the country.

According to complaints, the Color Fun Fest 5k in Houston last September was moved to a venue an hour away while a race in Stockon, California was moved in February to Easter Sunday.

The company does have a no-refund policy outlined on their website, but the Rays still fought to get paid back.

After repeated requests by the Rays and telling the company they were going to CBS 11, they were sent a refund request form and got their money back Friday.

The Rays want Consumer Justice -- or at least answers for all of the other upset racers.

Color Fun Fest LLC said they would get back to CBS 11 with answers Monday. CBS 11 has yet to receive a statement regarding the complaints.
