Cookie Battle! Pepperidge Farm Sues Grocer Trader Joe's

NEW HAVEN, Conn. (CBSDFW.COM/AP) — Commercial bakery Pepperidge Farm says Trader Joe's sells a cookie that too closely resembles its Milano brand and has filed suit against the grocery chain for trademark infringement.

The lawsuit, filed December 2 in federal court in Connecticut, contends that Trader Joe's is confusing customers with its Crispy Cookies that mimic Milano's signature oval shape.

The company seeks to block future sales of the item and be paid undisclosed damages.

Pepperidge Farm, a subsidiary of Campbell's Soup, first rolled out the Milano cookie in 1956 and trademarked its formula in 2010.

A spokesman for Monrovia, California-based Trader Joe's declined to comment on pending litigation.

Trader Joe's stores first opened in North Texas in 2012. There are now eight locations, from as far west as Fort Worth and as far east as McKinney.
