Balley's Total fitness is sending refunds to about a thousand Texans.

The Texas Attorney General's office says the company sent out fake past due notices to some 11 thousand former members across the state, and about a tenth actually paid.

The state says Balley's will start making restitution immediately.  They say the letters went so far as to tell recipients if they didn't pay, their names would be turned over to credit bureaus and have their credit ratings harmed.
Bally's operates 24 fitness centers in and around the Dallas, Houston and San Antonio areas.
