DALLAS (CBSDFW.COM) - Despite two run-ins with DeSoto police in the last three months, former Dallas District Attorney Craig Watkins avoids arrest.

The first one happened in May when police say Watkins' shoved his wife during an argument. The responding officer said he believed the violence would not continue and Watkins was neither arrested nor cited.

"We do this everyday. The officers have a lot of discretion out there in the way they choose to handle these calls. We believe they acted appropriately," says Nick Bristow with police.

Police say the second came last month, when someone called them claiming Watkins was drunk and lying in the road. Bristow says they made contact with him, and he failed a field sobriety test.

"Mr. Watkins parents live right around the corner from where he was detained. He wasn't uncooperative. So they chose to get a hold of his father who came to the scene and took custody of him," according to Bristow.

Bristow says the incident with Watkins was handled appropriately.

"Mr. Watkins was treated the same way we would treat anyone else. There was no special treatment given," says Bristow.

Calls to Watkins office were not immediately returned.
