UPDATE: Turlock Woman Pleads Not Guilty Of Murdering 2-Year-Old Daughter

TURLOCK (CBS13) - A Turlock woman pleaded not guilty to second-degree murder charges on Wednesday in the death of her 2-year-old daughter.

Brandy Lee Rose Devine, 24, is also charged with causing mental and physical suffering to her child and being under the influence of methamphetamine while she harmed her daughter.

"She's charged with one count of murder, second-degree murder, one count of child abuse and neglect," Deputy District Attorney John R. Mayne said.

The toddler, Stephanie Torres, was found dead and her Devine was arrested on Monday afternoon and charged with homicide, police said.

Turlock police officers responded to the 1100 block of N. Denair to assist emergency medical personnel after receiving a 911 call from a neighbor of a non-responsive child.

When officers arrived at the residence, the 2-year-old girl was deceased.

CBS13 spoke with one neighbor who heard the toddler's mother screaming for help. She made her way inside the home.

Next door neighbor Lydia Whitworth tried to save Torres, but it was too late.

"I was talking to the 911 operator," she said Wednesday. "I was telling her what I was seeing and she said 'Can you start CPR?' And I said 'There's no point' and I said 'This baby has been gone for quite a while.' I said she's gray and I touched her arm. She was cold."

Whitworth is haunted by what she witnessed. She says the young girl had special needs.

"She had her head up and her eyes were rolled to the back and she had a dirty diaper," she said. "You could see everything from the diaper coming out."

Prosecutors say the killing took place sometime during a three-day period between Friday and Monday. They say the tot suffered abuse from her mother for weeks before the girl's murder.

With her hair pulled back, Devine waved at family as bailiffs escorted her out of the Stanislaus County courtroom Wednesday.

After the brief hearing, relatives chose not to talk with reporters.

"We've been advised not to say anything," Devine's father said.

Police said three other children were in the house at the time, a 6-year-old girl, 4-year-old girl and an infant boy. They were taken into protective custody and turned over to Child Protective Services.

A teddy bear and candles were placed at the doorstep of Devine's home, which was boarded up Wednesday after it was broken into after her arrest. She's being held on $1 million bail.
