(CBS) NEW YORK - A 14-year-old boy has been arrested for allegedly sexually assaulting a 4-year-old girl at a McDonald's children's play area in Queens.

New York City Police say the unidentified teen was arrested and charged with a criminal sexual act on Thursday.

According to CBS New York, the incident happened on Tuesday inside the tubular play structure at a McDonald's play area.

The victim and her brother were reportedly playing when the suspect positioned himself near the girl in a way that their mother wouldn't see him.

The station reports the girl told her mother what happened. The woman immediately spotted the suspect and tried to stop him but he fled.

CBS New York did not specify how the boy assaulted the young girl, but the New York Daily News reports the boy grabbed the girl and forced her to perform a sex act on him.

A judge will decide on Thursday whether to hold the teen or release him to his parents, according to the station.
