Arrest Warrant Issued For Woman Accused Of Being Distracted Driver In Manslaughter Of Boy, 8

WESTMINSTER (CBS) — Officials issued an arrest warrant Tuesday for a 48-year-old Westminster woman who failed to appear in court on a misdemeanor vehicular manslaughter charge stemming from a collision that killed an 8-year-old boy.

The warrant was issued for Anita Sue Cherry when neither she nor her attorney appeared for a pretrial hearing, according to the courtroom clerk and court records.

Attempts to reach the prosecutor now assigned to the case -- Diana King -- or Cherry's listed attorney, Phil Zalewski, were not immediately successful.

Cherry was southbound on Shawnee Road in Westminster in her 2005 Ford Freestyle on Jan. 19 about 8 a.m. when she hit the boy near Iroquois Road, said Deputy District Attorney Michael Bardeen.

Andrew James Brumback, who was wearing a helmet as he pedaled to school on his bicycle, was pronounced dead at Huntington Beach Medical Center.

Cherry told investigators she never saw the youmgster, Bardeen said. The prosecutor did not know why Cherry was allegedly distracted, but she reportedly said after the accident that she momentarily took her eyes off the road.
