North Texas Man, EEOC Sue Wal-Mart For Discrimination
KELLER (CBSDFW.COM) - A Keller man claims that he was discriminated against because of his age and disability while working as a manager for Wal-Mart, and the U.S. Equal Employment Opportunity Commission has filed a lawsuit on his behalf.
David Moorman, who was 54 at the time, says his direct supervisor would call him "old man and old food guy," as well as directing comments toward him like, "You can't teach an old dog new tricks."
Moorman complained to Wal-Mart's human resources department, but nothing was done, according to the lawsuit. Moorman says the harassment continued and he was eventually fired because of his age.
Moorman also claims that he asked to be re-assigned to a store co-manager or assistant manager position, after he was diagnosed with diabetes. Wal-Mart rejected his reassignment request, according to the suit.
The EEOC's lawsuit is suing for lost wages and other damages for Moorman.
Randy Hargrove, a Wal-Mart spokesman, says the company respectfully disagrees with Moorman's claims and points out that Moorman was hired at 49 and promoted to store manager at 53.
"Wal-Mart does not tolerate discrimination of any kind. We ended Mr. Moorman's employment for job performance issues," said Hargrove. "We accommodated Mr. Moorman with a leave of absence when he informed us of his diagnosis of diabetes." Hargrove added that this was the only request made by Moorman in regards to his health.
