BP TIGERS FLYAWAY CONTEST 2012 OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.
1. HOW TO ENTER
a. The BP Tigers Flyaway Contest ("Contest"), being conducted by WXYT-FM (the "Station") will begin on June 1st, 2012 at approximately 7:00 a.m. Eastern Time ("ET") and end on July 31, 2012 at approximately 11:59 p.m. ET ("Entry Dates").
b. Entrants may participate in the Contest by registering online or by mail-in entry by mailing a 3"x5" card as follows:
1) ONLINE ENTRY: To enter via online registration, visit http://detroit.cbslocal.com/station/97-1-the-ticket during the Entry Dates and click the contest entry button to connect to the contest registration page. Each entrant must fully complete the online registration page with all required information including his/her name, complete address, valid email address, birth date, and phone number(s) (including area code(s)). After having read and agreed to these Official Rules, click the submit button to submit your online entry. All online entries must include all required information and must be received by 12:00 p.m. ET on June 30, 2012 to be eligible for a chance to win a Qualifying Prize in the first winner selection drawing and must be received by 12:00 p.m. ET July 31, 2012 to be eligible to win a Qualifying Prize in the second selection drawing. There is a maximum of one online entry permitted per person and per valid email address for the Contest. Any online entry submitted with an invalid email address will be disqualified. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. Entries submitted will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. Station's computer is the official time keeping device for the Promotion. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems.
2) 3"x5" INDEX CARD ENTRY FORM: On a 3"x5" card or piece of paper, legibly hand print your full name, complete address (including city, state and zip code), daytime phone number (including area code), e-mail address (if any), and date of birth; and mail it to "BP Tigers Flyaway Contest 2012" c/o 97.1 The Ticket, 31555 W. 14 Mile Road, Ste. 102, Farmington Hills, MI 48334.
All mail-in entries must be received by the Station by Tuesday, July 31, 2012. Entrants must allow sufficient time for postal delivery. The receive date for all mail-in entries shall be determined by the Station in its sole discretion, which shall be final and binding.
b. Only one entry per person regardless of the method of entry. Only one entry is permitted per outer mailing envelope. Entries submitted will not be acknowledged or returned. No mechanically reproduced, illegible or incomplete entries will be accepted. Contest entries will be deemed null and void and will be rejected if not submitted through authorized, legitimate channels. If a dispute as to the identity of any entrant (online or mail-in) cannot be resolved to Station's satisfaction, the entry will be deemed ineligible. Proof of submission of an entry shall not be deemed proof of receipt by Station. The Station is not responsible for lost, misdirected, illegible, incomplete or late entries or entries that are defective or unreadable, or entries not received due to any other difficulties regarding the entries.
2. ELIGIBILITY RESTRICTIONS
a. The Contest is open to all residents of the state of Michigan who possess a valid government-issued picture ID, and are 21 years of age or older at the time of entry. Employees of the Detroit Tigers and BP Global (collectively "Sponsors"), the Station, its licensee, and each of their respective parent, subsidiary, and affiliated entities, their advertising and promotional agencies, participating sponsors, and employees of other radio stations in the Detroit metropolitan area and the members of their immediate families and/or households are not eligible to participate or win.
b. Winners must meet all eligibility requirements to receive any prize package. You can only win a prize valued at $50 or more or event tickets valued at $100 or more (per ticket) from the Station once every 30 days but remain eligible to win prizes of $600 or greater, which can be won only once every six months Only one winner per household in any single Station promotion.
c. The winner must provide valid government-issued photo identification and provide their complete address, date of birth and phone number to claim a prize.
d. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements. The Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children's Online Privacy Protection Act.
3. PRIZES
a. Forty (40) Qualifying Prizes will be awarded. Each Qualifying Prize includes one (1) pass for a behind-the-scene tour of Comerica Park for one (1) person. The tour includes a visit, the dugout, and the broadcast booths. Tour will take place on either August 15, 2012 or August 16, 2012 (the tours of Comerica Park will be referred to as the "Qualifying Prize Dates"). The date of each Qualifying Prize winner's tour will be determined by the Station's Qualifying Prize winner drawing described below. Qualifying Prize winners will also be eligible for a chance to win a Grand Prize in a drawing conducted on their designated Qualifying Prize Date.
b. Two (2) Grand Prizes will be awarded. Each Grand Prize consists of the following (i) roundtrip coach airfare for two (2) people (winner and guest over 21) on a carrier of Station's choice originating from Detroit Metropolitan Airport to Cleveland Hopkins airport in Cleveland, Ohio and (ii) two (2) tickets to see the Detroit professional baseball game at Progressive Field in Cleveland on Sunday, September 16, 2012. The Approximate Retail Value ("ARV") of each Grand Prize is $800, but actual value of each Grand Prize may vary depending upon cost of airfare at time of airfare purchase.
HOTEL ACCOMMODATIONS, TRANSFERS, FOOD AND BEVERAGES, OR ANY OTHER EXPENSES ARE NOT INCLUDED IN THE GRAND PRIZES AND ARE SOLELY THE RESPONSIBILITY OF THE GRAND PRIZE WINNERS.
c. The prize winners shall be solely responsible for all other expenses not specified herein as being awarded including, without limitation, delivery, processing and handling fees, food beverages, taxes, gratuities, ground transportation to/from any Qualifying and/or Grand Prize-related event, and/or personal purchases. If a selected Grand Prize/Qualifying Prize-related event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of the Station, the Station's sole responsibility to the winners will be to award the remaining available portion of the prize and no substitution or compensation will be provided for the unawarded portion of the Grand Prize/Qualifying Prize.
d. All travel arrangements will be made by Station in their sole discretion and certain restrictions may apply. Each Grand Prize winner and their travel companion must travel on the same itinerary and are responsible for obtaining all required travel documents. Each winner and travel companion must sign a Publicity, Liability Waiver and Travel Release form prior to traveling. If a Grand Prize winner is unable to travel on the date as determined by Station, such prize winner will forfeit the prize package in its entirety and an alternate prize winner may be selected from all remaining eligible entries. Station and Sponsors are not responsible for flight delays or cancellations, game time changes or cancellations. GROUND TRANSPORTATION AND HOTEL ACCOMMODATIONS WILL NOT BE PROVIDED AS PART OF THE GRAND PRIZE PACKAGES. Other travel restrictions may apply. The Station reserves the right to remove or to deny entry to the winner and/or travel companion(s) if either engages in a disruptive manner or with intent to annoy, abuse, threaten or harass any other person at any Grand Prize/Qualifying Prize-related event. If Grand Prize winner's guest is under 18 years of age, the Grand Prize winner must be the guest's parent and/or legal guardian.
e. Prize certificates must be picked up at the office of the Station at the address listed below. Qualifying Prize winners will forfeit any prize or prize certificate not claimed by August 10, 2012 of winning and an alternate winner may be selected in a random drawing from all remaining eligible entries (time permitting). Grand Prize winners will forfeit any prize or prize certificate not claimed within two (2) days after their appearance at Comerica Park on August 15 or 16, 2012 or prize will be forfeited and an alternate winner may be selected in a random drawing from all remaining Qualifying Prize winners (time permitting). Prizes not claimed within the stated time limit will be forfeited. Forfeited prizes become the property of the Station.
f. There are no substitutions, transfers, or cash equivalents for prizes, except that Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. SELECTION OF WINNERS
a. Decisions of the Station management with respect to the Contest are final.
b. On July 1, 2012, twenty (20) potential Qualifying Prize winners shall be selected by the Station in a random drawing from all valid online and mail-in entries received between June 1, 2012 and 12:00 p.m. ET on June 30, 2012. Each potential Qualifying Prize winner will be notified by phone by the Station following the Qualifying Prize winner drawing. Qualifying Prize winners selected on July 1, 2012 will receive a Qualifying Prize Date of August 15, 2012 (time TBD).
c. On August 1, 2012, twenty (20) potential Qualifying Prize winners shall be selected by the Station in a random drawing from all valid online and mail-in entries received between 12:00 p.m. ET on June 1, 2012 and 12:00 p.m. ET on July 31, 2012. Qualifying Prize winners selected on August 1, 2012 will receive a Qualifying Prize Date of August 16, 2012 (time TBD).
d. At the end of each Qualifying Prize Date (August 15 and 16, 2012), the Station will select one (1) Grand Prize winner through a random drawing from the twenty (20) Qualifying Prize winners present on that respective Qualifying Prize Date. The Station will notify the Grand Prize winner on-site following the Grand Prize winner drawing. A maximum of one (1) Grand Prize winner will be selected at each Qualifier Prize Date, August 15 and 16, 2012 for a total of two (2) Grand Prize winners selected during the Promotion.
e. Entrants need not listen to the Station nor be present to win a Qualifying Prize. Qualifying Prize winners need not listen to the Station but must be present at their Qualifying Prize Date (August 15 or 16, 2012 depending on when the Qualifying Prize winner was selected) to be eligible to win a Grand Prize.
f. Qualifying Prize winners must execute and return any required affidavit of eligibility and/or liability/publicity release by August 10, 2012 or prize will be forfeited and Stations may elect not to award the prize to an alternate winner. Grand Prize winners must execute and return any required affidavit of eligibility and/or liability/publicity release 2 days of winning or as otherwise directed by Station at the time of notification or prize will be forfeited and Stations may elect not to award the prize to an alternate Grand Prize winner. Prize(s) will be awarded only upon confirmation of eligibility and completion of all requisite releases. If a potential contestant or winner cannot be contacted, fails to sign and return the required fully-executed affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of each winner. Each winner will be required to complete and submit an IRS Form W-9 with the winner's full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other CBS Radio station in Station's market) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.
b. By participating in the Contest, each winner agrees to have the winner's name, voice and likeness used in any advertising or broadcasting material relating to the Contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require Contest winners (and any travel companion(s) or guest(s)) to sign a liability release, agreeing to release and hold harmless the Sponsors, the Station, its licensee, their respective parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Contest.
d. If for any reason this Contest cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Contest, or if the Contest is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate, suspend, or modify the Contest. If the Contest is terminated before the original end date, the Station will select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date.
e. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station's website. Failure to comply with the rules of the Contest may result in a contestant's disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Contest, the Station reserves the right to disqualify that entrant from entering and/or winning future Contests and to prosecute and seek damages to the fullest extent permitted by law.
f. The Station reserves the right to make changes in the rules of the Contest, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Sponsors or Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel, terminate, suspend, or modify the Contest and shall not be required to award a substitute prize.
g. The Sponsors and the Station are not responsible for typographical or other errors in the printing, the offering or the administration of the Contest or in the announcement of a prize.
h. For the Official Rules, send a self-addressed stamped envelope for receipt by July 31, 2012 to "BP Tigers Flyaway Contest 2012 – Official Rules" c/o 97.1 The Ticket, 31555 W. 14 Mile Road, Ste. 102, Farmington Hills, MI 48334. For the names of the prize winners send a self-addressed stamped envelope for receipt by September 31, 2012 to "BP Tigers Flyaway Contest – Winner List" at the above address. Official Rules and Winner Lists (when completed) shall also be available during regular business hours at the main offices of the Station.
6. PRIVACY
a. By use of the Station's website or by entering the Promotion through the Station's website, you agree to the website's Terms of Use Agreement located at http://detroit.cbslocal.com/terms-of-use and to the use of your personal information as described in the Privacy Policy located at http://detroit.cbslocal.com/privacy-policy/
