Groups Seek To Dismiss Lawsuit On Renewable Energy

DENVER (AP) - Four environmental groups say a judge should dismiss a lawsuit challenging Colorado's renewable energy standard.

Environment Colorado, the Colorado Environmental Coalition, the Sierra Club and The Wilderness Society argue in court documents that the plaintiffs don't have standing to sue. A judge hasn't ruled yet on their motion to dismiss the lawsuit.

Businessman Rod Lueck, the American Tradition Institute and the American Tradition Partnership filed the lawsuit against the state in April. They say a Colorado law requiring larger utilities to get 30 percent of their energy from renewable sources by 2020 is raising consumers' electricity costs and violating the Constitution's interstate commerce clause by imposing burdens on the interstate market for electricity.

The state is fighting the suit.
