DENVER (CBS4) - A federal judge will decide Tuesday whether to cut the 14-year prison sentence of former Illinois governor Rod Blagojevich.

He's currently a resident of the Englewood Federal Prison in Littleton. He arrived in Colorado in 2012 waving to people and even making a stop at a local restaurant just before turning himself in to serve his original sentence.

A federal appeals court ordered the resentencing hearing after it threw out five of his 18 counts of corruption last year. According to reports, his wife recently wrote a letter to the judge pleading his early release for the sake of their daughters.

Also in support of a reduced sentenced are more than 100 people who testify about what a model prisoner he has been, from educating others to reportedly starting a  jailhouse rock band.

Federal prosecutors want his original 14-year sentence reinstated, saying he hasn't truly taken responsibility for his crimes and that upholding the stiff punishment will send a message.

Blagojevich will appear for the sentencing via video conference in his first public appearance since going to jail.
