NightSide - The Future Of The Court

BOSTON (CBS) - With the passing of Justice Scalia, there is now a glaring vacancy on the bench of the highest court in the land. Already the political battle over a potential nomination from President Obama is being fought, and many believe it is unlikely the Republican-dominated Senate will confirm anyone that the President puts forward. But is it wise to leave the court shorthanded for over a year if the Senate tries to hold out for the next President? Is it a problem that choosing Supreme Court justices has become such a partisan endeavor? Are Democrats being hypocrites by claiming Republicans should shut up and approve the President's pick?
