New Details Emerge In Death Of Baltimore Third Grader

BALTIMORE (WJZ)--New details emerge of what happened at a Baltimore City school where a young boy suffered an accidental fall and died days later.

WJZ's Amy Yensi spoke to the family's attorney and has more.

9-year-old Darrius Clark died Tuesday day night after an accidental fall at Gwynns Falls Elementary School. Investigators say he suffered a traumatic brain injury.

The family's attorney Tom Yost, says watching him fight for his life was hard on them.  Not knowing why is worse. He's now asking if the school followed safety guidelines? Was there a delay in getting help? How he suffered a brain injury ?

"Everybody has an expectation that their children will be safe in school," said Yost.

Darius' mother was called by the school at around 1:30 pm. Now, new information released to WJZ gives a clearer picture of the school's response.

Baltimore's Fire Department reports they got the call at 1:34 p.m. Medics arrived 7 minutes later. At 1:56 they rushed Darius to Johns Hopkins Children's Center, arriving 10 minutes later.

And even with a clearer picture of the medical response--Darius' family is questioning what happened inside the school and exactly when.

"We know when Darius' family got the call. We know when the 911 call came in.

Yensi: "Do you still have worries about the timeline of events."

"Yeah," says Yost. "They're entitled to an answer. They're entitled to an explanation. If this is something that could have been prevented in any way. Someone should be held accountable"

Baltimore City Police is investigating. The family is calling on the school system to do a thorough investigation, to help determine exactly what happened.

No word yet on when the autopsy will be completed.
