Lawsuit Brought By Trainee Shot During Police Training Exercise Dismissed
BALTIMORE (AP) -- A federal judge has dismissed a lawsuit brought by a Baltimore police trainee who was accidentally shot during a training exercise and refused a $200,000 settlement from the city.
The Daily Record reports that Raymond Gray's attorney, A. Dwight Pettit, previously said the settlement wasn't worth responding to and planned to go forward with a jury trial. The city argued $200,000 is the maximum a plaintiff can recover under the Local Government Tort Claims Act. When Gray never responded to the offer, the city moved to dismiss the case.
On Wednesday, Judge William Nickerson granted a motion to dismiss the case.
Gray sued the city after training officer William Scott Kern mistakenly used a live weapon in demonstrating the danger of standing in the potential line of fire, resulting in Gray losing an eye.
