MYERSVILLE, Md. (AP) -- A federal court has ruled in favor of Dominion Transmission in its bid to build a natural gas compressor station in Myersville.
U.S. District Court in Baltimore ruled on Monday that local zoning laws are pre-empted by the federal Natural Gas Act. The News-Post of Frederick reports that the court says parts of the Myersville town code that prevent the siting, construction or operation of the compressor station are null and void.
Dominion had sued Myersville after the Town Council denied a request to build a 16,000-horsepower gas compressor station in the Frederick county town. The council said local ordinances barred the project.
Dominion still must obtain an air quality permit from the Maryland Department of the Environment.
