Mother Of Drowned Children Fighting For Custody Of Survivors

DALLAS (CBS11) - The mother of three children who drowned this summer appeared in court Thursday hoping to get her two surviving children back from Child Protective Services.
Three of Patricia Allen's children drowned in June at an apartment complex pool.
She was later arrested for injury to a child after a witness reportedly said she was distracted by a cell phone while her kids played.
Allen's supporters insist that was never true.
Thursday's CPS hearing was an effort to regain custody of her surviving four-year-old and six-year-old children.
The judge ruled the children will remain in the department's custody while Allen undergoes drug and psychological evaluation. She will also take parenting classes. After the hearing her attorney insisted his client is a good mother who has been falsely accused of negligence.
"She was not negligent in any of her supervision of the kids. She was in fact in the pool when this occurred. We have stated that from the beginning. That proved to be correct and true, that she was never on the phone," Howard Rosenstein said.
Allen will be back in court November 18 for a review hearing.
