(CBSDFW.COM) - The woman accused of masterminding the murder of an Uptown dentist remains in a Mexico City jail awaiting extradition back to Dallas.

Brenda Delgado is accused of hiring a hitman to shoot and kill Kendra Hatcher in an Uptown garage. She then fled to Mexico but was arrested earlier this month.

Her attorney George Milner has filed a general discovery motion and says when his client returns to Dallas is anyone's guess.

"She will be brought back to Dallas, but I don't know when. I'm getting different stories from everyone I ask. Anywhere from one month to six months. I don't know how soon she'll be back," says Milner.

Milner says he had a plan in place in which his client would surrender to the FBI... but Mexican officials arrested her first and thwarted those plans.

"I know the Mexican authorities are working with American authorities, but if it had been done my way, she would be here now and we wouldn't be wondering when she will get back to Dallas."

Milner says he is anxious for her to get back to north Texas. "There are a lot of people making assumptions about this case that simply aren't true. We're looking forward to an actual courtroom instead of the court of public opinion."

Delgado is charged with capital murder and was placed on the FBI's Ten Most Wanted list before her arrest.
