SJ Police Violently Arrest the Wrong Man

A case of mistaken identity on the part of San Jose Police Officers results in an innocent man being violently arrested because cops believed he was a drug suspect.

It happened outside the Stop n' Save store at Capitol Expressway and Silver Creek last Friday when a man was walking out of the convenience store after trying to buy a lottery ticket. He was taken down by several police officers who violently handcuffed him and told him not to resist. But police had the wrong man. Click to Listen

Police released the 23 year old man once they realized he was not who they were looking for.

"They should have first talked to him, not pushed him down and stuff," said Carmen, who shops regularly at the convenience store. "If it were me, I'd press charges. Get a lawyer."

That's exactly what the victim, Henry Amador has done.

San Jose Police spokesman Jose Garcia tells KCBS this is an unfortunate set of situations.

"For that reason we have asked the internal affairs unit to look into it, and find out exactly what happened.

Amador's injuries included eight stitches on his eyelid.
