UPDATE: Sentencing For Cop Killer Delayed After Defense Requests Mistrial
WOODLAND (CBS13) - The sentencing for convicted cop killer Marco Topete has been postponed.
Topete was supposed to be formally sentenced today. However, the judge postponed the sentencing after the defense submitted a new request for a mistrial based on a Supreme Court case.
A new court date has been set for Feb. 7th.
In 2008, Topete fired 17 shots at Yolo County Deputy Jose Tony Diaz in an ambush-style attack.
Last November jurors found him guilty and sentenced him to death.
One juror said given the evidence, she had to choose the death penalty.
