Judge Issues Gag Order In Vallejo Officer Shooting Case

FAIRFIELD (AP) — A judge has issued a gag order prohibiting prosecutors and defense attorneys from publicly discussing details of the case involving the fatal shooting of Vallejo police officer James Capoot.

Prosecutors say the order issued Thursday by Solano County Superior Court Judge Peter Foor prohibits the district attorney's office and the public defender's office from revealing details of the case against 37-year-old Henry Smith Jr.

Smith is accused of fatally shooting the 43-year-old Capoot after a bank robbery and a chase.

Smith has been charged with murder with four special circumstances, including murder of a peace officer and murder in the commission of a robbery. He has pleaded not guilty.

Deputy District Attorney Karen Jensen says a hearing is set for Dec. 9 where the judge will consider issuing a gag order for law enforcement officers involved in the case.
