Alleged Vallejo Cop Killer Makes First Court Appearance
VALLEJO (CBS13) –- In a courtroom half filled with his family members and half with police officers, Henry Smith entered in shackles on Monday. The 37-year-old is accused of shooting and killing Vallejo police Officer James Capoot last week.
Henry Albert Smith Jr. of Fairfield delayed entering a plea for the murder of Capoot, 45, who was shot Thursday afternoon while pursuing Smith after a robbery at a Bank of America on Springs Road.
Police say Smith is the lone suspect who robbed a bank and then lead police on a foot chase that ended with Capoot being shot.
After a request from his court-appointed attorney, Smith's arraignment was delayed until next Thursday.
The judge did not allow pictures or video from inside the courtroom Monday after the public defender issued a motion to ban all electronic media during the case. The judge will decide whether to allow cameras next week.
Back in Vallejo, a man allowed CBS13 in his back yard for a first look at where Officer Capoot was shot and killed.
The only sign of any incident was a section of fence kicked to the ground.
Still, the man tells us he's had a difficult time coping with what happened in his yard last week.
"I'm going through a lot now," he said. "I didn't see the whole thing. I just heard the shots."
