Calif. Man Fatally Shoots Sister's Alleged Killer, Self Say Police

SAN JOSE, Calif. (CBS/AP) In what appears to be a deadly case of revenge, Wayne Sanchez, the older brother of a California woman who mysteriously disappeared a decade ago, shot and killed the man accused in his sister's death before killing himself, police said.

San Jose police Sgt. Jason Dwyer said  Sanchez, 52, followed 46-year-old Maurice Nasmeh, the prime suspect in his sister's disappearance, into a San Jose coffee shop Saturday night and shot him dead.

As police arrived at the scene, Sanchez walked into the parking lot and shot himself, Dwyer said. The two had initially met at a nearby restaurant, where police say Sanchez accused Nasmeh of killing his sister, Jeanine Harms, who vanished in July 2001.

Nasmeh spent 2 1/2 years in jail on charges that he killed 42-year-old Harms, but a judge dismissed the charges in 2007 after crime lab problems led prosecutors to concede they weren't ready to try the case. At the time, prosecutors still blamed Nasmeh for Harms' disappearance.

According to police, Nasmeh met Harms at a bar while she was on a date with another man. After partying together, the two went to Harms' apartment, said investigators. Nasmeh is believed to be the last person to have seen Harms alive.

Her body has never been found, but authorities presume she is dead.

During the investigation, police found carpet fibers in Nasmeh's car from a yarn project Harms was working on.

Nasmeh's attorney, Daniel Jensen, continued to maintain his client's innocence after his death.

"Justice didn't get done here," he told the San Francisco Chronicle. "Instead, we got two more victims, and we still have a killer out there walking free."
