NEW YORK (CBS/AP) Nicholas Brooks, son of Academy Award-winning songwriter Joseph Brooks, has been indicted in the  death of swimsuit designer Sylvie Cachay at a posh New York hotel.

Manhattan prosecutors announced Brooks' indictment Thursday, but did not disclose the charge and said details will not be released until a later court date.

Brooks, 24, is being held without bail on initial charges of attempted murder and strangulation of the 33-year-old Cachay, who was found dead in an overflowing bathtub at the SoHo House hotel Dec. 9.

Prescription drugs were found in the room, but the pills were in the bottle, and the woman had some small red marks on her neck, police said. The room was not in disarray, and no illegal drugs were found.

Brooks was not present in court and he did not testify before the grand jury, according to his lawyer.

Cachay, who didn't live with Brooks, may have checked into the hotel after a fire broke out in her West Village apartment Wednesday, Dec. 8.

Cachay and Brooks had been dating for about six months, according to her mother, Sylvia Cachay of McLean, Virginia. But she said her daughter had told her two weeks ago that the relationship was over.

Sylvie Cachay created a women's swimsuit collection called Syla using high-end fabrics and bright, bold patterns and colors. The suits retailed for $200 to $400 each, but she lost her backing and had to fold after the economy collapsed, according to her former publicist Kate Godici.

In an unrelated case, the defendant's father, Joseph Brooks, is fighting charges that accuse him of molesting would-be actresses in his Manhattan apartment. He was the composer for the "You Light Up My Life" ballad, which scored an Oscar in 1978.
