Shaquan Duley Update: Judge Denies Bond for South Caroline Mother Accused of Killing Her Sons

ORANGEBURG, S.C. (CBS/WCSC) Despite pleas from her attorneys, family, and friends, the 29-year-old mother accused of killing her two young sons was denied bond by a judge Monday afternoon.

The prosecution argued that Shaquan Duley, who is facing two counts of murder, should remain in the Orangeburg County Detention Center because she is a threat to the community, herself, and her 5-year-old daughter.

It is also believed that Duley could potentially be a flight risk, reports CBS affiliate WCSC.

Duley was arrested after authorities say she confessed to smothering her 2-year-old, Devean, and 18-month old, Ja'van, then strapping them into their car seats and rolling her car into a river.

Both of the children's bodies were pulled from the North Edisto River last month.

"This, of course, is a potential capital case," solicitor David Pascoe told WCSC. "Just the mere fact that this involves the murder of two people under a common scheme makes it a death penalty case. The mere fact that we have the murder of two children under the age of 11, makes a death penalty case. I need to inform the court that I have in no way and by no means have I ever excluded the possibility that I may seek the death penalty on Ms. Duley."

Duley's attorney Carl Grant fought for his client whom he said was diagnosed with a major depressive disorder with psychotic features only hours before she allegedly killed her two boys.

Due to the severity of his client's illness, Grant stated that Duley could not distinguish right from wrong. He also described three suicide attempts by Duley which occurred both before and after the murders, says WCSC.

Grant plans to cite Duley's unstable mental and drugged status at the time as part of his defense.

The judge said if Duley's trial date has not been set within six months, he will again hear her case to be let out on bond.
