Jaycee Dugard Update: Mother of Kidnapping Victim Denied Claim for Emotional Injury

SACRAMENTO, Calif. (CBS/AP) Jaycee Dugard's mother will have to sue the state of California if she wants monetary damages for emotional injury she says she incurred while her daughter was held against her will.

Terry Probyn felt she deserved compensation because state parole agents were unable to locate her daughter for 18 years while she was held by alleged captors Phillip Garrido, a convicted sex offender, and his wife Nancy.

However, after hearing Probyn's complaint, on Thursday  the Victim Compensation and Government Claims Board, which is in charge of compensating California crime victims, denied her claim.

Probyn had previously filed a suit against the state of California claiming officials with the Department of Corrections and Rehabilitation failed to do their jobs in locating her daughter.

The Dugard family also cited psychological, physical and emotional damage.

In that case, lawmakers decided to award a $20 million settlement to Jaycee Dugard, now 30, and the two children she bore with her alleged kidnapper...but not to Probyn.

Probyn's former attorney who filed the claims says he does not know if she will go through with another lawsuit.
