Jose S. Barrera, of Elgin, Ill., was arrested early Monday after police said he smoked marijuana in a drive-thru lane of a McDonald's while a police car was directly behind him in line, a report says.

The police officer said he smelled the smoke as he was waiting and noticed that it was coming from the car window in front of him, reports The Chicago Sun-Times.

The officer then proceeded to pull the car over and allegedly found an entire Tupperware container full of marijuana. Barrera was charged with possession and was released on $120 bond pending a July 22 hearing, according to the Sun-Times.
