Georgia man charged in fiancée's murder

CATOOSA COUNTY, Ga. - A Georgia man has been arrested for the murder of his fiancée, whose was found shot in a car parked in a wooded area Friday, reports CBS affiliate WDEF.

Deborah Abney, 46, died from a single gunshot wound to the back of the head, according to a medical examiner. Her fiancé, Brian Colby Davenport, was arrested soon after the examiner announced the cause of death.

Catoosa County Sheriff Gary Sisk told WDEF that the couple had children, and have been together for years.

Davenport was at the scene when officers arrived. He told detectives that earlier in the afternoon he and Abney were at a custody hearing for their children who are in foster care, according to police.

"It was a continuing hearing to see if the children should stay with the state or possibly do away with the parental rights with the children," Sisk said.

The judge determined the children should remain in foster care. After that ruling, Davenport allegedly told police that couple got sandwiches and alcohol, and drove to the woods to discuss the judge's decision.

Davenport said it was there that Abney shot herself. However, police don't believe that story, Sisk said.

"It was learned that some of the evidence had been moved and tampered with and the individual had given us a couple false statements as far as what had actually taken place that evening," Sisk said.

Davenport is being held without bond.
