"I was told that she blew a zero on the Brethalyzer," said Rick Bynes to People. "She didn't have a single drink that night. My daughter doesn't drink."

The 26-year-old actress was arrested on suspicion of DUI early Friday in Los Angeles, after reportedly sideswiping a police vehicle with her car.

Rick Bynes told the magazine he thinks the cop, who arrested his daughter, was at fault for pulling out in front of the actress at the intersection where she was pulled over. He continued, saying she was not under the influence, but instead "upset and very emotional."

Bynes was released on $5,000 bail, she will have to show up in court when a date is set.
