LOS ANGELES (KNX1070) — Supporters of Proposition 8 are expected to go before a judge Monday and ask him to overturn the ruling made by Chief U.S. District Judge Vaughn R. Walker.
CBS Chief Legal Analyst Andrew Cohen told KNX 1070's Ed Mertz that proponents of the measure are expected to ask Judge James Ware for a new trial, which Cohen predicts will be denied.
Supporters of the ban on gay marriage believe Judge Walker should have disclosed his same-sex orientation and the fact that he was in a long-term relationship prior to his ruling.
"I think he will deny the motion and I think he tell supporters of Proposition 8 that their best chance to get out from under Judge Walker's ruling is not by attacking Judge Walker, but rather by the appeal that's going go to the 9th Circuit and then up the ladder to Washington," he added.
